Child Custody Same Sex Couples

On November 7, 2013, the Supreme Court of Florida entered interesting opinion holding certain parts of Section 742.14 unconstitutional as applied to deprive the parental rights of a lesbian woman who provided her ovaries to her lesbian partner so both women could have a child to raise together as equal parental partners and who did parent the child for several years after the child’s birth.  DNT v. TMH, 38 Fla.L.Weekly S812 (2013).

Parents Rights Terminated in Favor of Grandparents

The Fourth District ruled that a parent's rights could be terminated in favor of the paternal grandparents where it was in the child's best interest. L. W., the mother v. Department of Children and Families, 36 Fl. L. Weekly D2195. In this case, there was substantial evidence which supported the termination of the mother's rights based on abandonment.
