Fourth District Court of Appeals found it was an error for the trial court to grant assisted living facility's motion to compel arbitration where terms of arbitration agreement substantially diminish plaintiff's statutory rights under the Assisted Living Facilities Act. The arbitration agreement which provides for arbitration as provided by American Health Lawyers Association alternative dispute resolution rules is contrary to public policy because the AHLA rules provide that "clear and convincing" standard applies to award of consequential, exemplary or special damages.
